新北市一名呂姓男大生在去年參加班上舉辦的菲律賓海外畢業旅行，其
中一晚見心儀女同學喝醉獨自回房休息，竟尾隨進房對女同學強行喇舌
摸下體。
女同學回台後提告，呂男雖坦承乘機猥褻犯行，但因《刑法》規定，境
外犯罪必須是內亂、外患、毒品、偽造貨幣或最輕本刑3年以上重罪，我
國司法才有管轄權，新北地檢署只得將呂男不起訴。
處分指出，去年7、8月間，呂男男大生參加班上到菲律賓的海外畢業旅行，其中一晚竟趁心儀的女同學喝醉酒後獨自回房，偷偷尾隨入內，爬上床對女同學強行喇舌猥褻下體後離去。
女同學回台後傳簡訊質問呂男，呂男坦承犯行並道歉，女同學隨即報警提告。
檢察官調查發現，呂男雖認罪，但因為案發地在境外，且呂男涉犯乘機猥褻罪，法定刑度為6月以上、5年以下徒刑，並非最輕本刑3年以上的重罪，依《刑法》第7條規定屬不罰，新北地檢署只好將他不起訴。（游仁汶／新北報導）
